What Is a Listing Agreement and How Long Should It Be?

What a listing agreement covers

A listing agreement is the contract you sign with your agent that spells out how your home gets marketed, priced, and sold, and it usually runs 90 to 180 days. The length is negotiable though, and what matters more than the number is whether you can get out of it if the relationship stops working.

It names the price you are starting at, the commission split, and what your agent is responsible for doing. In Nevada it also has to be in writing to be enforceable, so a verbal understanding with an agent is not a listing.

How long a typical term runs

Most Las Vegas listing agreements run somewhere between 90 and 180 days. A shorter term feels safer the first time you sell, but it also means re-signing paperwork if the home has not sold and you still want to work with the same agent.

A longer term gives the agent room to adjust strategy without a deadline hanging over every price conversation. Neither length is required by law. It is a negotiation between you and the agent before anything is signed.

What exclusive right to sell means

Most agreements in Las Vegas are exclusive right to sell, meaning the agent earns the commission no matter who finds the buyer, even if you find one yourself. That surprises some sellers the first time they hear it.

The tradeoff is that the agent is committing real marketing spend and time on your home. An exclusive agreement is what makes that investment make sense for them.

Can you cancel it

Most agreements include a way out before the term ends, but it is not automatic and it is not the same in every brokerage. Ask about it before you sign, not after you are unhappy.

A few things sellers commonly ask about:

  • Whether there is a cancellation clause and what notice it requires
  • Whether you owe anything if you cancel and later sell on your own
  • Whether a buyer your agent introduced still counts after cancellation, for a set window
  • Who signs off on the cancellation, just you or the brokerage too

If an agent will not put the cancellation terms in writing before you sign, that tells you something.

What it does not commit you to

Signing a listing agreement does not mean you have to accept any offer that comes in. You still decide what to accept, counter, or reject.

It also does not lock in your price forever. Prices get adjusted mid-listing all the time, and that requires your agreement, not a unilateral call by the agent.

Simple summary

A listing agreement is a written contract, usually 90 to 180 days, that gives one agent the exclusive right to sell your home for that period. The term length is negotiable, and so is how you can get out of it early. Read the cancellation section before you sign, and ask for anything unclear to be explained in plain terms.
