Should You Use an Agent When Buying New Construction?

Yes, and the reason is simpler than most explanations make it. The person sitting in the model home is a sales agent employed by or contracted to the builder, and their job is to represent the builder. They are usually pleasant and genuinely knowledgeable about the product. They are just not working for you.

Who the person in the model home works for

Builder sales agents are good at their job. They know the floor plans, the lot inventory, and the current incentives better than anybody. But when it comes time to decide what a fair price is, whether an incentive is worth taking, or what to do when the timeline slips, they answer to the builder.

That is not a criticism of them. It is just the structure. Somebody in that conversation is looking out for the builder’s interests, and if you do not bring representation, nobody in that conversation is looking out for yours.

Register your agent on the first visit

This is the part that actually costs people money, and it happens before anyone realizes it is happening.

  • Most builders treat your first visit or first online registration as the moment representation gets locked in
  • If you walk into a model home alone and sign in without naming an agent, many builders will not allow you to add one later for that community
  • Policies differ from builder to builder, and some allow an agent to pre-register you or to catch up within a short window
  • The fix is free. Bring your agent with you the first time you visit the community, or at the least, have your agent call the sales people beforehand.

You do not get a second chance at this on most communities. It is worth a text message before you go look at models on a Saturday.

What an agent actually does on a new build

  • Reads the builder’s purchase contract, which is the builder’s own document and not the standard Nevada residential purchase agreement most buyers have seen
  • Presses on the incentive math, especially when the incentive is tied to using the builder’s lender
  • Tracks the build and the closing date, and pushes when it slips
  • Helps you arrange independent inspections and walkthroughs, including before drywall goes up and again before the builder warranty period runs out

That inspection point gets skipped constantly. A new home is not an inspected home. It was built by people, quickly, and a licensed inspector working for you will find things.

What it costs you

Builders commonly account for buyer agent compensation in their pricing, and it is generally negotiated the same way as any other purchase. Since August 2024, compensation has to be spelled out in your written buyer agreement before you tour, which includes model homes. So ask early, get the number in writing, and know what you are agreeing to before you fall in love with a floor plan.

Simple summary

The builder’s sales agent represents the builder. Bringing your own agent costs you little or nothing in most cases, and it gets you somebody reading the builder’s contract, checking the upgrade and incentive math, and ordering inspections on your behalf. Register your agent on your very first visit to a community, because most builders will not let you add one after the fact.
